DMCA Policy

Vulu LLC ("Vulu") respects the intellectual property rights of others and complies with the U.S. Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512. This policy explains how copyright holders can submit a takedown notice for content stored in a Vulu personal library, how users can submit a counter-notice if their content was removed by mistake, and Vulu's policy on repeat infringers.

1. Designated DMCA Agent

Vulu has registered a Designated Agent with the U.S. Copyright Office for receipt of DMCA notifications. The agent's contact information is:

Notices submitted to any other address or email may not be acted on. Please use the email above for fastest response; mailed notices are accepted but will take longer to process.

2. How to submit a takedown notice

If you are a copyright owner (or authorized to act on behalf of one) and you believe content stored in a Vulu library infringes your copyright, send a written notice to the Designated Agent above. To comply with the DMCA (17 U.S.C. § 512(c)(3)), your notice must include all of the following:

1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
2. Identification of the copyrighted work claimed to have been infringed. If the notice covers multiple works on the Service, a representative list of those works.
3. Identification of the material claimed to be infringing and information reasonably sufficient to allow Vulu to locate the material. The most useful identifier is the full Vulu URL where the material is hosted, or, if you cannot locate that, the source URL (Instagram, TikTok, YouTube, etc.) from which the material was originally saved.
4. Information reasonably sufficient to allow Vulu to contact you: your full legal name, mailing address, telephone number, and email address.
5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement, made under penalty of perjury, that the information in your notice is accurate, and that you are the copyright owner or are authorized to act on behalf of the owner.

Notices that do not contain all six elements may not be valid under the DMCA and may delay our response. Knowingly submitting a materially false notice under penalty of perjury can expose you to liability for damages, including costs and attorneys' fees (see 17 U.S.C. § 512(f)).

3. What Vulu does after receiving a valid notice

On receipt of a notice that substantially complies with § 512(c)(3), Vulu will:

• Promptly remove or disable access to the identified material in the affected user's library.
• Notify the user whose library contained the material that the material was removed pursuant to a DMCA notice, and provide them a copy of the notice (with the complainant's personal contact information optionally redacted on request).
• Inform the user of their right to submit a counter-notice as described below.
• Record the takedown in Vulu's internal DMCA log for repeat-infringer accounting.

Vulu does not adjudicate copyright disputes between users and complainants. Our role under the DMCA is procedural: we remove on a valid notice, we restore on a valid counter-notice if no court action follows, and we account for repeat infringement.

4. Counter-notification

If you are a Vulu user and you believe content was removed from your library by mistake or misidentification, you may submit a counter-notification to the Designated Agent. To be effective under § 512(g)(3), your counter-notice must include:

1. Your physical or electronic signature.
2. Identification of the material that was removed and the location at which it appeared before removal (the Vulu URL or library entry).
3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
4. Your full legal name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the United States District Court for the District in which your address is located (or, if your address is outside the United States, the U.S. District Court for any judicial district in which Vulu may be found), and that you will accept service of process from the person who provided the original takedown notice or that person's agent.

On receipt of a counter-notice that substantially complies with § 512(g)(3), Vulu will forward a copy to the original complainant and inform them that the content will be restored in 10 to 14 business days unless the complainant first files a lawsuit seeking a court order to restrain the alleged infringing activity. If no such lawsuit is filed within that window, Vulu will restore access to the content.

5. Repeat-infringer policy

Vulu maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. As a baseline, three valid DMCA takedowns against a single user's library — meaning notices that Vulu acts on and that are not successfully countered — will result in termination of that user's account. Vulu reserves the right to terminate sooner where the pattern, scale, or willfulness of infringement warrants it, and to decline to terminate where the takedowns appear retaliatory, abusive, or otherwise not made in good faith.

Termination for repeat infringement is a cause-based termination under our Terms of Service. No refund of prepaid subscription time will be issued.

6. Misrepresentation

Section 512(f) of the DMCA provides that any person who knowingly materially misrepresents (a) that material is infringing, or (b) that material was removed by mistake or misidentification, is liable for any damages, including costs and attorneys' fees, incurred by Vulu, by the alleged infringer or the copyright owner, or by any party injured by such misrepresentation.

Do not submit a DMCA notice unless you actually own the copyright in question (or are authorized to act on the owner's behalf) and have considered fair use and other defenses in good faith.

7. Trademark, defamation, and other non-copyright complaints

This policy and the Designated Agent address apply only to copyright infringement notices under the DMCA. For trademark complaints, defamation complaints, privacy complaints, or other non-copyright issues, please email hello@vulutv.com with the relevant details. Vulu reviews these complaints on a case-by-case basis under our Terms of Service and applicable law.
