How to report copyright infringement on Vulu, and how to respond if your content was removed by mistake.
Vulu LLC ("Vulu") respects the intellectual property rights of others and complies with the U.S. Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512. This policy explains how copyright holders can submit a takedown notice for content stored in a Vulu personal library, how users can submit a counter-notice if their content was removed by mistake, and Vulu's policy on repeat infringers.

If you are a copyright owner (or authorized to act on behalf of one) and you believe content stored in a Vulu library infringes your copyright, send a written notice to the Designated Agent above. To comply with the DMCA (17 U.S.C. § 512(c)(3)), your notice must include all of the following:
Notices that do not contain all six elements may not be valid under the DMCA and may delay our response. Knowingly submitting a materially false notice under penalty of perjury can expose you to liability for damages, including costs and attorneys' fees (see 17 U.S.C. § 512(f)).
On receipt of a notice that substantially complies with § 512(c)(3), Vulu will:
Vulu does not adjudicate copyright disputes between users and complainants. Our role under the DMCA is procedural: we remove on a valid notice, we restore on a valid counter-notice if no court action follows, and we account for repeat infringement.
If you are a Vulu user and you believe content was removed from your library by mistake or misidentification, you may submit a counter-notification to the Designated Agent. To be effective under § 512(g)(3), your counter-notice must include:
On receipt of a counter-notice that substantially complies with § 512(g)(3), Vulu will forward a copy to the original complainant and inform them that the content will be restored in 10 to 14 business days unless the complainant first files a lawsuit seeking a court order to restrain the alleged infringing activity. If no such lawsuit is filed within that window, Vulu will restore access to the content.
Vulu maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. As a baseline, three valid DMCA takedowns against a single user's library — meaning notices that Vulu acts on and that are not successfully countered — will result in termination of that user's account. Vulu reserves the right to terminate sooner where the pattern, scale, or willfulness of infringement warrants it, and to decline to terminate where the takedowns appear retaliatory, abusive, or otherwise not made in good faith.
Termination for repeat infringement is a cause-based termination under our Terms of Service. No refund of prepaid subscription time will be issued.
Section 512(f) of the DMCA provides that any person who knowingly materially misrepresents (a) that material is infringing, or (b) that material was removed by mistake or misidentification, is liable for any damages, including costs and attorneys' fees, incurred by Vulu, by the alleged infringer or the copyright owner, or by any party injured by such misrepresentation.
Do not submit a DMCA notice unless you actually own the copyright in question (or are authorized to act on the owner's behalf) and have considered fair use and other defenses in good faith.
